These Terms of Service (“Terms”) govern your access to and use of the ChikChik website, mobile applications, and related services (collectively, the “Services”) operated by ChikChik Technologies, Inc. (“ChikChik,” “we,” “us,” or “our”).

By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.

1) Definitions

  • “Attendee” means a user who purchases or holds a ticket to an event.

  • “Organizer” means the event creator/seller who lists an event and sells tickets.

  • “Event” means a live, in-person experience for which a ticket is sold.

  • “Ticket” means a digital ticket (including QR code) issued through the Services.

  • “Order” means a ticket purchase transaction made through the Services.

2) What ChikChik is (Marketplace role)

ChikChik is a marketplace that enables Organizers to list events and sell tickets to Attendees. Unless explicitly stated otherwise, ChikChik is not the Organizer of any event and does not control how an event is run. The contract for a ticket is between the Attendee and the Organizer.

We may provide tools for discovery, ticketing, customer support, and check-in, but the Organizer is responsible for delivering the event as described and complying with all applicable laws and venue rules.

3) Eligibility and accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services, unless a parent/guardian consents and applicable law permits.

You agree to provide accurate information, keep your account secure, and notify us if you believe your account has been compromised.

We may suspend or terminate accounts that violate these Terms or create risk to users, payment partners, or the platform.

4) Event listings and information

Event listings are provided by Organizers. Organizers must provide accurate and complete information, including venue/location, date/time, contact information, and refund policy.

ChikChik may remove or restrict listings that are inaccurate, misleading, incomplete, prohibited, or otherwise non-compliant.

5) Purchases, tickets, and check-in

When you purchase tickets through ChikChik, you authorize us (and our payment partners) to charge your selected payment method for the total amount shown at checkout.

After purchase, you will receive a digital ticket, typically including a QR code for entry. Entry requirements (e.g., ID checks, venue rules, age restrictions) are determined by the Organizer and/or venue.

One organizer per order: Each checkout/order contains tickets from one Organizer only (no mixed-organizer carts).

6) Fees, pricing, and taxes

Ticket prices are set by Organizers. ChikChik may charge a platform/service fee that is disclosed at checkout and/or in the organizer experience.

Applicable taxes may also be collected where required.

7) Refunds, cancellations, and disputes (important)

Refunds are governed by (a) the Organizer’s stated refund policy and (b) our Refund & Cancellation Policy, which is incorporated by reference into these Terms.

Key points:

  • Refund requests are handled through ChikChik.

  • All card refunds must be processed through the platform (no off-platform card refunds for orders paid by card).

  • If an event is cancelled, Attendees are eligible for refunds according to the Refund & Cancellation Policy.

  • If an event is postponed or materially changed (for example: significant change in date, venue, or headline performer), Attendees will be offered refund options according to the Refund & Cancellation Policy and applicable law.

Organizer response expectations: Refund requests are routed to the Organizer and Organizers are expected to respond promptly (target: within 5 business days). If an Organizer does not respond in time, ChikChik may issue a refund when appropriate to protect Attendees and reduce disputes.

Before a chargeback: If you have an issue with an order, please contact Support before filing a dispute with your bank. We can often resolve issues faster through our platform process.

8) Payment processing and statement descriptor

Payments are processed by third-party payment providers. Your use of payment services may be subject to additional terms required by those providers.

Your statement descriptor may appear as “CHIKCHIK*EVENTNAME” or similar to help reduce confusion.

9) Organizer terms (if you organize events)

If you create events or sell tickets as an Organizer, you must also agree to the Organizer Agreement and Payments, Payouts & Refunds Addendum (Organizer Terms), which include additional requirements such as verification, refund obligations, payout timing, reserves, and prohibited event categories.

ChikChik may require identity/business verification and/or proof-of-event for certain events prior to enabling ticket sales.

10) Prohibited conduct and prohibited events

You agree not to use the Services for illegal, deceptive, harmful, or high-risk activity. This includes, without limitation:

  • illegal activity or illegal goods/services (including controlled substances);

  • adult-oriented prohibited content where restricted by payment partners or law;

  • gambling/raffles/sweepstakes or similar restricted gaming activity;

  • money-movement or “third-party payment” activity disguised as ticketing;

  • misleading listings, scams, or fraud;

  • harassment, hate, threats, doxxing, or harmful behavior.

We may remove content, cancel listings, suspend accounts, delay payouts, and/or cooperate with law enforcement as appropriate.

11) Content and intellectual property

The Services, including our software, branding, design, and content, are owned by ChikChik or our licensors and are protected by intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Services unless we give you written permission.

If you post content (such as event descriptions, images, or messages), you grant ChikChik a non-exclusive, worldwide, royalty-free license to use that content to operate, market, and improve the Services.

12) Third-party links and services

The Services may include links to third-party websites or services. We do not control third parties and are not responsible for their content or practices.

Mobile app stores (Apple/Google) may impose additional terms and requirements.

13) Disclaimer of warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHIKCHIK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

CHIKCHIK DOES NOT GUARANTEE THAT EVENTS WILL OCCUR AS LISTED, THAT AN ORGANIZER WILL PERFORM, OR THAT ACCESS WILL ALWAYS BE UNINTERRUPTED OR ERROR-FREE.

14) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHIKCHIK WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR ANY EVENT, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHIKCHIK’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO CHIKCHIK (IF ANY) IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

15) Indemnification

You agree to defend, indemnify, and hold harmless ChikChik and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services, (b) your content, (c) your violation of these Terms, or (d) your event (if you are an Organizer).

16) Suspension and termination

We may suspend or terminate your access to the Services at any time if we believe you violated these Terms, created risk, engaged in fraud, or harmed other users or the platform.

You may stop using the Services at any time.

17) Governing law and venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Unless prohibited by law, you agree that any dispute arising out of these Terms or the Services will be brought in the state or federal courts located in California, and you consent to personal jurisdiction and venue in those courts.

(If you prefer arbitration language instead, tell me and I’ll provide an optional arbitration clause you can swap in.)

18) Changes to these Terms

We may update these Terms from time to time. The most current version will always be posted on this page with the “Last updated” date. Continued use of the Services after changes means you accept the updated Terms.
